This is to show they are real and some other than you made the copy who was involved. 2. You stated that you knew that person was there and it is then your due diligents to avoid the other person. You did not by your description. You continue to make the same size turns and not add space between you and the other person. Being Aware and not acting is what will hurt you in court. From only what I read in YOUR opening statement you are responsible. Sorry you are F$$$$D!! 3. I have been involved in an accident like this. The difference is I was training for national and the skiier ran me over. A ski tip either side of my spine. Thankfully I was wearing a "Flax jacket" that is issued to police under my gear. The comment I was given by police is the brusing looks the same as a 45 caliber bullet impact. The scarey part is no flax jacket I would not be alive, it would have been a threw and threw. 4. GET A LAWYER, NOW!!! 5. see above. 6. To understand that you admit you knew the other snow sports participate was there and turned back not giving enough space is on you. GET A LAWYER 7. My accident cost that skiier alot of money. The family paid of my dept for the race year and covered a summer of rehab, a physical trainer, and a new custom race board. I still went and raced at nationals. My coached started the suit due to me not riding for next two days after impact. The kicker for me in court was the ski said he was not use to snowboarders on the hill!!!!! We have been around for 20+years!!!!!!!!!!!!!! the judge said that was no excuse. the judge also mentioned that since I was wearing a bright yellow down hill suit and green jacket he finds it hard not to see me. 8. The back of the lift ticket protects the resort and tells you want your due diligents is. The fact you saw the other person shows your awareness and lack of judgement. You should have made space sincce you are aware of the problem and that puts you behind the person. Hence you are going to be found liable!!!!!! Remmember the skiiers code of conduct was written by skiiers and amended to include snowboarder. The judge will not understand the fact snowboards have a blind side turn (not ture because you can turn your head!!). I have raced, taught, and coached so looking at what you wrote I have to say sorry you are at fault. 9. MOST IMPORTANT IS READ ALL THE ABOVE AND GET FIN TO ERASE ALL THE POST PERTAINING TO THIS. TAKE EVERYONES ADVISE AND GET A LAWYER. DO NOT THINK OF THE KID, THINK OF THE OTHER SNOW SPORT PERSON(helps me as a paramedic-all are patients even family) . THE WAY YOU HANDEL THIS WILL ALSO COME INTO PLAY AT THE RULING IF IT GOES THAT FAR. 10. LAWYER FOR ADVISE AND PREPARE TO LAWYER UP. ALL DOCUMENTATION YOU NEED A COPY. ALL DOCTORS OPIONS NEED A SECOND OPION. 11. THE MOST IMPORTANT FACT IS ALL PARENTS WILL PROTECT AN INJURIED CHILD LIKE A PITBULL ON ROPE. DO NOT ACUSE THEM OR THE KID(PLAINTIFF) OR YOUR WORLD WILL STOP. REMMEBER THINK TWICE BEFORE YOU SPEAK. THIS MEANS THINK AND THEN HAVE THE LAWYER THINK AND ANSWER THE QUESTIONS. I am wondering who is up for going and who is already going riding this week? Nakiska or where ever. I get few days off now so any riding is good for me.

I have days off this week. tuesday to friday. I would be up for riding if anyone is going out let me know and i will come down and ride. i am in red deer or give me a shout three five two nine one three four scott

i am still at work and days off not to far off. I would like to get out and ride with some carvers being an ex racer. I dropped in at COP once in awhile. I will post when I will be heading out to ride and see who is around. Enjoy the NES, I am jealous. Dig some trenchs for me.

I have the 26 to the 1 off. I am going on a road trip. I will be heading out to kicking horse,revelstoke and onto big white,and sunpeaks. I would be up for meeting on 26 with people at sunshine or the lake.
